Description
Calls for the Supreme Court to intervene in disputes about partisan elections raise big questions about judicial legitimacy and involve difficult tradeoffs between protecting democracy and judicial restraint. Focusing on several past examples, including the “mother of all election interventions” — the 2000 Bush v. Gore decision– and the recent Colorado ballot exclusion case, this class will equip students to understand the stakes involved– as the country faces the hotly contested upcoming November elections.
